Kecemasan Negarawan dari Bali Tentang Mahkamah Konstitusi

Dari Orasi Pengukuhan IDG Palguna menjadi Guru Besar

AKHIRNYA! Begitu sorak saya dalam hati mendapat kabar dan undangan dari kawan se-perteater-an saya, dulu di Sanggar Putih,  I Dewa Gede Palguna, dikukuhkan sebagai guru besar tetap Ilmu Hukum Tata Negara, UNUD, 30 November 2024.

Sebagai teman “gradag-grudug” kemudian berlanjut terus hingga kini menjadi teman bertanya, berdiskusi, debat sedikit, tentu saja saya mendapat banyak ilmu dan terutama informasi yang bagi saya “penting dan A1” sebagai tukang tulis jurnal di media.

Apa yang bisa saya tulis sekarang tentang Profesor IDG Palguna, adalah kesaksian subyektif yang agak susah dihindari sekaligus obyektif yang juga tak mungkin saya abaikan.

Saya akan memulai dari yang obyektif, karena ini demi kepentingan umum, yaitu isu paling penting dalam konteks kesehatan demokrasi, yang sudah terlanjur menjadi kesepakatan seluruh bangsa Indonesia untuk bernegara yang satu mengadopsi system demokrasi. Bukan lainnya.

Di bagian awal orasi, Prof Palguna dengan lantang mengingatkan:  tidak ada masa depan yang cerah bagi negara hukum Indonesia tanpa kehadiran Mahkamah Konstitusi yang berintegritas.

Satu sisi ini tidak mengagetkan, karena Palguna sudah berteriak soal ini sejak kisruh fenomena “Paman Samsul” di MK. Jadi, podium pengukuhan Guru Besarnya kemarin itu puncak teriakannya sebagai akademisi.

Yang mengagetkan -tepatnya terpana- Palguna justru sedang menghajar habis institusinya sendiri tanpa rasa sungkan.

Ini adat tidak biasa dari tradisi “menjaga nama baik korps” yang biasa diidap oleh pejabat maupun mantan pejabat sebuah institusi di negeri ini.

Dan percayalah, Palguna dalam menghajar itu pasti tidak dengan hati bersuka melainkan dengan hati berduka. Luka dan sedih. Itu saya maklumi betul. Apalagi mengingat begaimana keterlibatannya di awal berdirinya MK sebagai hasil reformasi 98.

Palguna, anak muda dari Bali kala itu, berjibaku, nyaris sendirian, di Panitia Ad Hoc I Badan Pekerja Mahkamah Permusyawaratan Rakyat (PAH I BP MPR) yang bertugas menyiapkan naskah rancangan perubahan UUD 1945 pada saat membicarakan pembentukan

Mahkamah Konstitusi  tahun sidang 2000 – 2001. Palguna adalah anak muda Bali yang ikut di wilayah episentrum membidani lahirnya MK dan selanjutnya  menjadi barisan Hakim MK periode awal. Barisan Hakim MK yang reformis kinyis-kinyis dan berhasil menjaga marwah MK sebagai pengawal konstitusi dengan sangat baik.

Jadi jika di podium ilmiah, Universitas Udayana, 30 November 2024, kembali Palguna tetap teriak lantang dengan konsen yang sama: mengawal konstitusi, tentu itu bukan sekadar  orasi ilmiah.

Itu adalah “kemarahan akademis”  yang memang harusnya dengan tiada lelah selalu dikumandangkan dari sebuah lembaga Pendidikan Tinggi, milik Negara,  pencetak para sujana bagi bangsa.

Untuk satu ini jangan juga salah, dalam badai kisruh MK jilid Paman Samsul, Palguna “dipaksa” menjadi Ketua MKMK, membereskan perkara tersebut, mencuci piring para yang pesta tanpa pernah ikut pestanya! Saya sempat mempertanyakan hal ini.

Dan saya sangat bisa memaklumi setelah Palguna sedikit membeberkan alasan kenapa ia akhirnya bersedia.

Dalam catatan saya, dan benar seperti yang ia sampaikan di buku orasinya -bisa anda buka di link yang saya sertakan di atas-  Palguna, Profesor, telah menyampaikan kecemasan yang bukan menyoal dirinya belaka sebagai “alumni” MK melainkan menyoal “nasib” Negara ini.

Kecemasan yang mem-publik dari pribadi seorang Palguna yang komplit: aktivis, akademisi, aparatur Negara dan..rakyat!

Ada lima butir cemas (“Panca Cemas” -guyonan saya menanggapi bagian ini) yang diurai padat dan lugas oleh Profesor Hukum Tata Negara UNUD ini.

Intinya adalah gugatan sang professor terhadap integritas MK. Baik integritas persona para hakimnya maupun kelembagaannya yang tentu saling kait mengait.

Kelima kecemasan Prof. Palguna saya coba ringkas, dalam bahasa saya sendiri, mohon maaf jika keliru,  adalah: (1)  potensi lolosnya produk UU dari mekanisme screening MK sebagai akibat dari permainan sah secara hukum pembuat UU (DPR-Pemerintah).

(2) memutus sengketa kewenangan antar lembaga Negara, berpotensi memecah belah pemerintah jika hakim dalam tekanan primordial.

(3) pelaksanaan pemutusan pembubaran parpol ataupun memutus tidak terhadap pembubaran parpol, yang pasti akan menimbulkan chaos bahkan keamanan nasional termasuk keamanan personal para hakim.

(4) memutus perselisihan hasil pemilu, yang berpotensi mendegradasi “wibawa” MK mengurusi soal-soal “cemen” begitu.

(5) soal kewenangan pelaksanaan pemakzulan presiden dan wakil presiden, di mana taruhannya adalah stabilitas politik. Bisa dibayangkan petaka apa yang terjadi jika dalam menggumuli 5 hal itu, MK bekerja tanpa integritas sebagai pengawal pamungkas konstitusi!

Kecemasan itu sesungguhnya telah dijawab sendiri oleh Prof Palguna di orasinya itu sendiri di bagian akhir, “Saya sangat yakin public trust dan public confidence itu akan mampu diraih kembali sehingga Mahkamah Konstitusi akan kembali berada pada posisi sebagai lembaga negara yang paling dipercaya di negeri ini!”

 Saya harus menyampaikan hormat saya kepada teman yang profesor  sekaligus profesor yang teman ini, bagaimana kembali ia harus berjibaku jilid dua seperti di tahun 2000-2001 saat kelahiran Mahkamah Konstitusi.

Pertempuran kali ini adalah  bagi “kelangsungan hidup” dan marwah sebuah lembaga demokrasi, penjaga konstitusi berbasis constitutional model, bernama Mahkamah Konstitusi! Pertempuran integritas! Dan kali ini saya yakin Prof Palguna tidak sendirian lagi berjibaku.

Kini sebagai Guru Besar,  saya yakin ada dukungan dari entitas dan komunitas para sujana khususnya bidang hukum dan sosial politik.

Terutama dari Udayana, sebagai “markas besar” suara akademik Bali, yang tentulah bangga memiliki  tambahan seorang “jenderal”lagi -jenderal lapangan sekaligus akademik pula- sehingga  pasti akan semakin diperhitungkan di pusat wilwatikta Indonesia Raya!
